Static Workspace number ignored

Bug summary
I have configured static workspaces with three workspaces. When I move a window down on the last workspace, a new workspace is created.
Steps to reproduce
- use static workspaces
gsettings set org.gnome.mutter dynamic-workspaces false
- set static workspace count to 3
gsettings set org.gnome.desktop.wm.preferences num-workspaces 3
- open a window on the third workspace
- press super+down
What happened
A fourth workspace was created and the active window is move to the forth workspace
What did you expect to happen
No additional workspace should have been created and the window should stay on the last workspace
