Layer selection with the Move and Alignment Tools could pick layers with visible pixels in a circle around the curor position
With either of these two tools, the Move Tool and the Alignment Tool, one tends to mis-select layers that lie underneath. This happens especially when the object you want to select has a lot of fine details that are transparent, especially when it's a text layer.
Probably the simplest solution is to have the Move Tool work similarly to the Healing Tool - in that it would affect an area around the cursor within the radius of say 10px. If you missed the actual text within a text layer by only a few pixels, you'd still grab hold of the intended layer, because the tool would now simply select the top-most layer within that radius.
Selection in the Alignment Tool should work in a similar way. In the current version you tend to mis-select layers that lie underneath, again, because you miss the intended layer by a couple of pixels.
